Delaware's courts are small and unusually specialised. The Superior Court handles civil damages claims and serious crime; the Court of Chancery, sitting without a jury, decides corporate and fiduciary disputes and is the reason so many American companies are incorporated in the state. Federal cases go to the District of Delaware, itself a major patent venue.

For an injury claim, Delaware applies modified comparative negligence with a 51 percent bar. For a business dispute involving a Delaware entity, ask whether the matter belongs in Chancery — the answer changes the timetable, the cost and whether a jury is involved at all.
