How divorce works in New York

  • Residency. Generally one spouse must have lived in New York for two years before filing, or for one year if the couple married in New York, lived here as a married couple, or the grounds arose here.
  • No-fault ground. A spouse can state under oath that the marriage has been irretrievably broken for at least six months. The divorce is granted only after property, support and custody issues are settled or decided.
  • Equitable distribution. Marital property is divided fairly, which does not always mean equally. Property owned before the marriage, inheritances and gifts from third parties are usually separate property.
  • Support. Spousal maintenance follows a statutory formula, with room for the court to adjust. Child support starts from a percentage of combined parental income — for example, 17% for one child and 25% for two — up to an income cap.

If you and your spouse agree on everything, an uncontested divorce can be filed with standard court forms and usually costs far less than a contested case. Many local lawyers offer flat fees for this.
