Divorce in Idaho: residency, property and parenting rules

Idaho divorce cases are heard in the magistrate division of the district court, where magistrate judges also hear child custody and other family law cases. Idaho allows no-fault divorce on the ground of irreconcilable differences, so most cases turn less on why the marriage ended than on dividing property, setting support and building a parenting plan. People hire a divorce attorney to protect assets, retirement accounts and time with their children. This page lists 25 attorneys and law firms in Idaho who handle divorce matters.

Before you file

  • Residency. The spouse who files must have lived in Idaho for six full weeks immediately before filing.
  • Grounds. Besides irreconcilable differences, Idaho Code 32-603 still lists fault grounds, including adultery, extreme cruelty, willful desertion and conviction of a felony.
  • Timing. The other spouse has 21 days after service to file an answer. No final decree can be entered until at least 21 days after service, unless both parties agree to an earlier trial.

Idaho is a community property state

  • What is shared. Property acquired by either spouse during the marriage is generally community property, and so is income from separate property unless the spouses agree otherwise in writing.
  • How it is divided. Courts divide community property substantially equally unless there are compelling reasons not to, looking at factors such as the length of the marriage, health, earning capacity and retirement benefits.

Children come first

  • Best interests. Custody is decided by the child's best interests. Idaho Code 32-717 lists factors including the parents' and child's wishes, stability, adjustment to school and community, and domestic violence.
  • Self-help. The Idaho courts' Court Assistance Office offers divorce forms and instructions for people starting without a lawyer; a contested case often takes six months or longer.

How to Choose a Divorce Lawyer in Idaho

  • Check the license. Every attorney admitted in Idaho can be looked up through the Idaho State Bar, together with any public discipline. Do it before the first meeting.
  • Ask about divorce cases specifically. General practice is not the same as a track record in your type of matter: ask how many similar cases the lawyer handled recently and how they ended.
  • Know the local rules. Idaho is a community property state and its trial courts are organised into seven judicial districts. A lawyer who practices here will factor that in from the first consultation.
  • Local courts matter. Procedures, filing practice and judges differ from county to county even within Idaho. Ask whether the lawyer regularly appears in the courts that will hear your case.
  • Get the fee agreement in writing. Hourly rate, flat fee or contingency, what counts as costs, and what happens if the case ends early — all of it should be on paper before work starts.
  • Compare several profiles. 25 divorce attorneys in Idaho are listed here, with the largest groups in Boise. Profiles carry direct contacts, so you can reach two or three of them without an intermediary.
