How the courts are organised

Delaware's court system is small and unusually specialised. The Court of Chancery, a separate equity court with no jury, decides corporate and fiduciary disputes and is the reason a large share of American companies are incorporated in the state. The Superior Court handles civil claims for damages and serious crime, and the Delaware Supreme Court hears all appeals. Federal cases fall to the District of Delaware, itself a major patent venue.

Points that shape Delaware cases

— Attorneys are admitted by the Delaware Supreme Court, and the bar is notably small relative to the volume of corporate litigation heard here.
— Corporate governance disputes are decided by judges applying a deep body of Chancery precedent rather than by juries.
— The state applies modified comparative negligence with a 51 percent bar.
— Marital property is divided equitably, and divorce requires a period of separation.
