Products liability attorneys represent people injured by defective or dangerous products: vehicles and vehicle components, medical devices and implants, prescription drugs, industrial and power equipment, household appliances, children's products and contaminated food.

Claims are built on three theories — a defect in design, a defect in manufacturing, or a failure to warn. Liability can reach the manufacturer, distributor and retailer, and in many states it does not require proof of negligence at all, only that the product was defective and caused the harm.

Before you hire

  • Keep the product, the packaging, the manual and the receipt. The physical item is usually the single most important piece of evidence.
  • Ask whether the firm litigates against manufacturers itself or refers cases on. These matters need engineering experts and deep pockets.
  • Ask how a mass tort or class action would affect you. Joining a consolidated proceeding is sometimes better than an individual suit, sometimes much worse.
