Insurance disputes are contract disputes with specialised rules. The policy language, the notice provisions, the proof-of-loss requirements and the appraisal clause usually decide the outcome, and the insurer's own file often shows how the number was reached.

Before you hire

  • Read the denial letter carefully and keep every piece of correspondence. Insurers must generally state the policy basis for a denial, and that stated basis becomes the battleground.
  • Document the loss before repairs: photographs, video, inventories, estimates from independent contractors.
  • Watch the deadlines in the policy itself, which are often shorter than the general limitation period for contracts.
  • Ask whether the attorney takes these cases on contingency and whether your state allows recovery of attorney fees from the insurer.
