Consumer law attorneys represent people against businesses: debt collection harassment, credit report errors, identity theft, deceptive advertising and sales practices, auto fraud and lemon law claims, predatory lending, and abusive loan servicing.
Several of the governing statutes shift attorney fees onto the losing business and provide statutory damages, which is why cases that look too small to litigate are often taken on without an upfront fee.
Before you hire
Collections, foreclosure defence and bankruptcy address the same problems from other directions.
Sometimes. Most state lemon laws cover new vehicles only. A minority — including New York, New Jersey, Massachusetts, Connecticut, Minnesota and Rhode Island — have separate used-car statutes with their own mileage and price thresholds. Elsewhere a used buyer relies on the remaining factory warranty, dealer warranties or fraud law.
It works as a sequence: report the defect during the warranty period, give the manufacturer a reasonable number of repair attempts, notify the manufacturer in writing, go through arbitration if your state requires it, and then claim a refund or replacement. Documentation at every step is what decides the outcome.
A lemon law gives the buyer of a defective new vehicle the right to a replacement or a refund when the manufacturer cannot repair it in a reasonable number of attempts. Every US state has one, and the federal Magnuson-Moss Warranty Act adds a nationwide layer covering consumer products generally.
