Cannabis Law in Illinois: what is legal and what is still a crime

Adult-use cannabis is legal at 21, but the Cannabis Regulation and Tax Act draws firm lines, and crossing them can still mean fines or charges. People hire a cannabis lawyer to defend possession or driving charges, clear old records or obtain a state business license. This page lists 5 attorneys and law firms in Illinois who handle cannabis and marijuana law matters.

Possession limits and common violations

  • Residents 21+. Since June 12, 2026, up to 60 grams of flower, 10 grams of concentrate and 1,000 mg of THC in infused products, counted cumulatively.
  • Nonresidents 21+. Half those amounts: 30 grams of flower, 5 grams of concentrate and 500 mg of THC.
  • Under 21. Possessing a small amount (10 grams or less) is a civil law violation punishable by a fine; larger amounts can be criminal, and driving privileges may be suspended if a vehicle was involved.
  • Where and how. Use is banned in public places, in any vehicle, on school grounds and near anyone under 21. In a vehicle, cannabis must be in a secured, sealed or resealable, odor-proof, child-resistant container that is inaccessible.
  • Home growing. Only registered medical cannabis patients 21 and older may grow, up to 5 plants taller than 5 inches per household.
  • Driving. For drivers without a medical cannabis registry card, having 5 ng/mL or more of THC in whole blood, or 10 ng/mL in another bodily substance, within 2 hours of driving is DUI.

Clearing old records

  • Automatic expungement. Non-conviction records for minor cannabis offenses (30 grams or less) were set for automatic expungement on a schedule with a final deadline of January 1, 2025. A 2026 law (P.A. 104-0463) expanded cannabis expungement eligibility, so check current rules for your case.
  • Convictions. A motion to vacate and expunge a qualifying misdemeanor or Class 4 felony conviction is filed in circuit court, such as in Urbana for a Champaign County case or Jerseyville for Jersey County.

Business licensing

  • Two regulators. The Department of Financial and Professional Regulation licenses dispensaries; the Department of Agriculture licenses cultivation centers, craft growers, infusers, processors and transporters.

How to Choose a Cannabis & Marijuana Law Lawyer in Illinois

  • Check the license. Every attorney admitted in Illinois can be looked up through the Attorney Registration and Disciplinary Commission, together with any public discipline. Do it before the first meeting.
  • Ask about cannabis & marijuana law cases specifically. General practice is not the same as a track record in your type of matter: ask how many similar cases the lawyer handled recently and how they ended.
  • Local courts matter. Procedures, filing practice and judges differ from county to county even within Illinois. Ask whether the lawyer regularly appears in the courts that will hear your case.
  • Get the fee agreement in writing. Hourly rate, flat fee or contingency, what counts as costs, and what happens if the case ends early — all of it should be on paper before work starts.
  • Compare several profiles. 5 cannabis & marijuana law attorneys in Illinois are listed here. Profiles carry direct contacts, so you can reach two or three of them without an intermediary.
