Social Security Disability in Arkansas: SSDI, SSI and the appeals clock

Disability benefits are a federal program, but the initial medical decision on your claim, and usually the reconsideration, is made by a state agency. Arkansas Disability Determination for Social Security Administration, at 701 Pulaski Street in Little Rock, works under an agreement with SSA to gather medical evidence and decide whether a claimant is disabled. Many claimants bring in a representative after a denial. This page lists 13 attorneys and law firms in Arkansas who handle Social Security Disability and SSI matters.

SSDI or SSI?

  • SSDI. Social Security Disability Insurance is for people who are "insured" through FICA or self-employment taxes paid on their own earnings.
  • SSI. Supplemental Security Income is need-based: it serves people with a disability who have limited income and resources.
  • Same medical standard. For adults, both programs use the same disability criteria.

Four appeal levels, 60 days each

  • Reconsideration. A fresh review by someone new.
  • Hearing. An administrative law judge hears your case. You can appear in person, by telephone, by online video on your own device, or by agency video at an SSA office.
  • Appeals Council. Reviews the judge's decision.
  • Federal court. A civil action in U.S. District Court. Springdale, in Benton and Washington counties, falls in the Fayetteville Division of the Western District of Arkansas.

Each step generally must be requested within 60 days after you receive the decision; SSA presumes a notice arrives five days after its date.

How representative fees work

  • Approval required. In most situations a representative cannot charge or collect a fee without SSA's written approval.
  • Fee agreement cap. Under an approved fee agreement, the fee cannot exceed the smaller of 25% of past-due benefits or $9,200, the maximum for favorable decisions issued on or after November 30, 2024.

How to Choose a Social Security Disability Lawyer in Arkansas

  • Check the license. Every attorney admitted in Arkansas can be looked up through the Supreme Court of Arkansas, together with any public discipline. Do it before the first meeting.
  • Ask about social security disability cases specifically. General practice is not the same as a track record in your type of matter: ask how many similar cases the lawyer handled recently and how they ended.
  • Local courts matter. Procedures, filing practice and judges differ from county to county even within Arkansas. Ask whether the lawyer regularly appears in the courts that will hear your case.
  • Get the fee agreement in writing. Hourly rate, flat fee or contingency, what counts as costs, and what happens if the case ends early — all of it should be on paper before work starts.
  • Compare several profiles. 13 social security disability attorneys in Arkansas are listed here, with the largest groups in Little Rock. Profiles carry direct contacts, so you can reach two or three of them without an intermediary.
