How the courts are organised

Arkansas circuit courts are the trial courts of general jurisdiction, organised into judicial circuits and divided internally into civil, criminal, domestic relations, probate and juvenile divisions. District courts handle misdemeanours and small claims. Appeals go to the Arkansas Court of Appeals and then the Supreme Court of Arkansas. Federal cases fall to the Eastern or Western District of Arkansas.

Points that shape Arkansas cases

— Attorneys are licensed by the Supreme Court of Arkansas; status and discipline are public.
— The state applies modified comparative fault, barring recovery where the claimant's share equals or exceeds the defendant's.
— Marital property is divided equally unless the court explains in writing why an unequal split is fair.
— Arkansas has a constitutional cap on contingency fees in personal injury cases, which is worth understanding before signing a fee agreement.
